These terms are the agreement between you and QTNET (keytodev) (see the legal notice), based in France (“we”), for using Switchbud, the website and the alerts and widgets it serves. Switchbud is free to use; Pro is an optional paid subscription (see Switchbud Pro, below). By signing in, you agree to them. If you don't, please don't use Switchbud.
Your account
You sign in with your Twitch account, so you also have to follow Twitch's Terms of Service and Community Guidelines, and be old enough to use Twitch where you live (at least 13). You're responsible for what happens on your account, including what the chat bot does with the settings you choose. Keep your widget URLs to yourself: anyone with one can see those alerts and widgets. If one leaks, make new ones on the Alerts page.
What you put in
The images, videos, sounds, text and settings you add stay yours. You give us permission to store them and show them wherever you use Switchbud — in your dashboard and on your stream — only so we can run the service for you. Only upload things you have the right to use; no music or artwork you don't have permission for, nothing illegal, hateful or sexual involving minors. We may remove anything that breaks these terms.
That includes packs you import: only import a pack you're allowed to use — one you bought, or made — under its own licence. A pack's code runs walled off from your account, but it's still someone else's code: we don't check what it does, and we're not responsible for it.
Sharing packs
When you share a pack, you confirm you made it or have the right to share it — a pack you bought usually comes with a licence for you alone. You let anyone with the link (and, if you choose, anyone browsing the gallery) install a copy and use it on their stream. Copies already installed stay with the people who installed them if you stop sharing. Your Twitch name and picture show on the pack's page.
Anyone signed in can report a shared pack. We host shared packs without checking them first; when we're told a pack breaks the law or someone's rights — through a report, or by writing to us — we look at it promptly and take it down if it does. Five reports from different people hold a pack until we've looked.
Switchbud Pro
Pro is an optional subscription that raises the limits on what you can keep and opens the premium packs (see the Pro page). The price and the period — monthly or yearly — are shown on the payment page before you pay. You pay by card, through Stripe. Pro renews by itself at the end of each period until you cancel. You can cancel at any time from the dashboard (Settings → Plan → Manage billing and cancel): Pro then stays on until the end of the period you have paid for, and you are not charged again. If a payment fails, Stripe tries again for a few days, and Pro stays on in the meantime. If we change the price, it applies from your next period, and we will tell you before.
Only the streamer can subscribe, from their own account, for their own channel. When you subscribe you ask for Pro to start straight away. If you are a consumer, you have the right to withdraw within 14 days of subscribing; if Pro has already started at your request, you pay for the time you have had. To use this right, write to us. When Pro ends, nothing you made is deleted: you keep your widgets, uploads and packs, but cannot add more until you are back under the free limits. A premium pack stays on your channel once installed, but installing one needs Pro. Pro given by hand or earned through invites is not a subscription and ends on its own date.
Using it fairly
Don't use Switchbud to harass anyone, to break the law, or to break Twitch's rules. Don't try to get into other people's accounts or data, overload the service, or get around its limits.
Tips
Switchbud doesn't process payments. When you connect a tip service (Ko-fi, StreamElements, Tipeee, Streamlabs, Buy Me a Coffee, Fourthwall or Throne), the money goes through it, under its terms; we only receive a note that a tip happened so we can show it. Problems with a payment are between you, the tipper and that service.
The chat bot
Filters, quotes and giveaways act on your Twitch channel as you. They can delete messages and time viewers out, never ban. You choose the settings and you're responsible for them. Giveaways are yours to run: we pick the winner(s) at random from the entries; prizes, eligibility and any rules where you live are up to you.
No guarantees
We work to keep Switchbud running well, but it's provided “as is”: it may sometimes be down, lose an event, or change. As far as the law allows, we're not liable for indirect losses — a missed alert, a lost sponsor, lost earnings — and our total liability is limited to what you paid us in the last 12 months, which for a free service is nothing. Nothing here limits rights you have by law that can't be limited.
Ending
You can stop at any time and delete your account from the dashboard (Home → Account); this also ends a Pro subscription, so you are not charged again. We may suspend or close accounts that break these terms, and may stop offering Switchbud — if so, we'll try to tell you in advance.
Changes
If we change these terms, the date at the top changes. For anything important we'll tell you in the dashboard first. Using Switchbud after a change means you accept it.
Problems, law and contact
Something wrong? Write to keytodev@proton.me first — most things are fixed that way. If you're a consumer and we can't settle it together, you can take it for free to the consumer mediator: [mediator name and website].
These terms are governed by the law of France. If you live elsewhere in the EU, you keep the protection your own country's consumer law gives you, and you can go to court there or in France.
